Terms and Conditions
This Agreement is between PharmaTerra Inc. and you ("you" or "Customer"). This Section sets forth the terms and conditions which apply to the use by you of the PharmaTerra Inc. Sites (as defined below) and any other subscription product or service offered for sale by PharmaTerra Inc. and/or its affiliates (collectively, "Company "). The right to use any product or service offered by Company is personal to you and is not transferable to any other person or entity. Company reserves the right to make changes to the Company sites, policies, and these Terms at any time without notice.
1. Use of the Company Sites
The Company Sites contain links to other Web sites, resources and advertisers. Company is not responsible for the availability of these external sites nor does it endorse or is it responsible for the contents, advertising, products or other materials made available on or through such external sites. Under no circumstances shall Company be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to a user in connection with the use of or reliance on any content, goods or services available on such external site. You should direct any concerns to such external site's administrator or webmaster.
2. Disclaimer of Warranty; Limitation of Liability
Company neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement on the Company sites, nor for any offensive, defamatory or obscene posting made by. Under no circumstances will Company be liable for any loss or damage caused by your reliance on information obtained through the content on the Company sites. It is your responsibility to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through the Company sites. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice or other content, including but not limited to financial, health, or lifestyle information, opinion, advice or other content.
You agree to defend, indemnify and hold harmless Company, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use by you of the Company Sites, including claims by other users of your equipment, access, products or membership.
Our standard ground shipping takes one week within the continental United States. For international orders, we ship via Federal Express, UPS or an equivalent service. Generally international shipments take two to four weeks from day of shipment unless customs causes a delay for some reason.
If you have not received your order within 21 days from your purchase date, please send an email to firstname.lastname@example.org to request a reshipment of your order.
If you entered the wrong address on our order form and we are forced to reship your package, there will be an additional shipping and handling charge equal to your original order.
To check the status of your order, update your mailing address or request reshipment because you never received your product, please send an email to email@example.com.
5. Sales and Distribution
Customer and/or distributor will not (re)sell any product on eBay, Amazon, any of their affiliate's websites or any other auction website or online marketplace. Prices do not include and are net of any foreign or domestic governmental taxes or charges of any kind that may be applicable to the sale, licensing, marketing or distribution of the products. Distributor understands and acknowledges that all sales are final and that they are not entitled to return any product for a refund. Company will not be responsible for any delays or lack of delivery due to customs clearance issues.
6. Cancellation Policy
Once an order has been submitted your credit card will be charged. Our ordering process is streamlined so your order will immediately be sent to processing and then shipping. Due to the high volume of orders we receive we will be unable to cancel an order after submitted. Please order carefully.
7. 90 Day Return Policy:
We take great pride in the superior quality of our products and want you to be pleased with your purchase. We believe in offering the very best value, quality and selection to our customers. You may return any unused and unopened item purchased from us for any reason within ninety (90) days of your purchase. Your complete satisfaction is our ultimate goal. You may return any item shipped by Company, keeping the following in mind:
- You should return the item to us within 90 days of your purchase date. There will be a 15-day grace period in addition to the 90 days.
- You must return any unopened portion of the product and the refund is limited a maximum of three used bottles.
- Original shipping fees are non-refundable and Company will pay for return shipping.
To request a refund you must obtain an RMA (Return Merchandise Authorization). Requests must be made electronically via email to firstname.lastname@example.org and submitted with your order information and explanation of the why you wish to return the product. You will receive your RMA via email once our customer service department has identified your eligibility for a return under our policy. Please do not call for an RMA. If you return your product without a RMA number you will not be refunded. For returns via mail, you must carefully package the product, and we must physically receive the return within the 90 day period, or the 15 day grace period. Company reserves the right, at its sole discretion, to reject any return that does not comply with these requirements. Abuse of our return policy by way of it's multiple repeat use by a same customer or customer group will not be tolerated; in such cases Company reserves the right, at its sole discretion, to reject any return that it considers to be an abuse of the policy. Once your return has been received, a refund will be issued within 30 days and an e-mail confirmation will be sent.
8. Paid Offers
On paid offers there are no continuity charges and you will only be billed once for your purchase. For example, if you buy 1 bottle of a product sold on the PharmaTerra online store, you will be charged for the bottle plus shipping & handling.
Statements made by Company have not been evaluated by the US Food and Drug Administration (FDA). The FDA Dose not evaluate or test herbs. These products are not intended to diagnose, treat, cure or prevent any illness or disease. Consult with your physician for diagnosis or treatment. Use herbs as per instructions and always watch for any allergic reactions.
The information presented on this site is not presented with the intention of diagnosing any disease or condition or prescribing any treatment. It is offered as information only, for use in the maintenance and promotion of good health in cooperation with a licensed medical practitioner. In the event that any individual should use the information presented on this website without a licensed medical practitioner's approval, that individual will be diagnosing for him or herself. IP addresses are not linked to your personal information.
* Information from Other Sources
For reasons such as improving personalization of our Service (for example, providing better product recommendations or special offers that we think will interest you), we might receive information about you from other sources and add it to our account information. We also sometimes receive updated delivery and address information from our shippers or other sources so that we can correct our records and deliver your next purchase or communication more easily.

We do not rent or sell your peronal information. It is not disclosed to other parties for commercial purposes. Information we collect is generally used for the following purposes:

Company will not sell or rent member or former member specific information, including name, address, telephone number and payment information.
We reserve the right to disclose personal information, including Sensitive Information, when we believe that such disclosure is appropriate to comply with the law or a request by a government official, to protect the rights or property of Company, or to enforce our Terms and Conditions of Use. In the event that Company or substantially all of its assets are acquired by a third party, member information and Sensitive Information may be some of the transferred assets.
Use of Data Collected
We use your personal, demographic and profile data to enhance your experience at our site and to enable us to present content we think you might be interested in. We use your contact information to send you information about our company and promotional material from our partners. We may also use your personal, demographic and profile data to improve our site, for statistical analysis, for marketing and promotional purposes, send SMS alerts or notification, and for editorial or feedback purposes for our advertisers. Information collected by us may be added to our databases and used for future telemarketing, SMS text-messaging, e-mails or postal mailings regarding site updates, new products and services, upcoming events, and/or status of orders placed online. SMS Offering and Opt-out rights
By completing or submitting a registration form or partial registration form you are consenting to receive SMS, wireless or other mobile offering to your cell phone. You understand that your wireless carrier's standard charges and rates apply to these messages. For SMS text messages, you may remove your information by replying "STOP", "END", or "QUIT" to the SMS text message you have received and we will remove your personal information within 10 days of receiving such request.
We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from member lists, analyzing data, providing marketing assistance, processing credit card payments, and providing member services. Active customers and former customers will occasionally receive information on products, services, special deals, and a newsletter.

Company serves general users of the World Wide Web. We support and comply with the Children’s Online Protection Act (COPPA) and we do not knowingly collect information from children under the age of 13, nor do we share such information with third parties. Children under the age of 18 may use Company only with the involvement of a parent or guardian.
